§ 5. FRANCHISE NONEXCLUSIVE.

(a)

Franchise nonexclusive. This franchise shall not be construed as any limitation upon the right of the City to grant to other persons, rights, privileges, or authorities equivalent to the rights, privileges, and authorities herein set forth, in the same or other streets, alleys, or other public ways or public places. The City specifically reserves the right to grant at any time during the term of this franchise or renewal thereof, if any, such additional franchises for a cable communications system as it deems appropriate.

(b)

Conditions. Any additional cable television franchises granted by the City shall contain equivalent terms and conditions as this franchise, including without limitation provisions of public benefit with equivalent cost, taking into account the size and population of the franchised areas.
